1. Acceptance of Terms

By accessing, purchasing, or using the services provided by Patrick White Publishing, you agree to be bound by these Terms and Conditions.

These Terms form a legally binding agreement between Patrick White Publishing and the client regarding the use of our publishing, writing, design, illustration, editing, marketing, and related services.

By proceeding with any service, payment, deposit, invoice, agreement, or project confirmation, you acknowledge that you have read, understood, and accepted these Terms and Conditions.

 

2. Services Provided

Patrick White Publishing provides professional publishing and creative services, including but not limited to:

  • Book writing and ghostwriting services

  • Editing and proofreading

  • Book cover design

  • Custom illustrations

  • Book formatting and layout

  • E-book and print book publishing support

  • Amazon KDP and distribution assistance

  • Audiobook production

  • Book trailer production

  • Author website design

  • Marketing and promotional services

  • Article writing and content services

  • Printing and related publishing support

The exact scope of work, deliverables, timeline, and pricing will be outlined in the relevant invoice, service agreement, proposal, or written project confirmation.

 

3. Project Scope and Service Agreement

Each project is based on the specific services selected and agreed upon by the client.

The project scope may include:

  • Deliverables

  • Timelines

  • Revisions

  • Payment terms

  • Service details

  • Project specifications

Any changes, additions, or requests outside the agreed project scope must be confirmed in writing. Additional services, major revisions, new requirements, or changes to the original brief may result in extra charges and timeline adjustments.

 

4. Payment Terms

All prices are quoted in Australian Dollars unless otherwise stated. Payment terms will be confirmed through the relevant invoice, agreement, or written communication.

A deposit or upfront payment may be required before work begins. Progress payments, milestone payments, or final payments may also apply depending on the nature of the project.

Work may be paused, delayed, or withheld if payments are not made according to the agreed schedule.

 

5. Refund Policy

Refund requests are reviewed on a case-by-case basis and depend on:

  • The specific service purchased

  • The stage of the project

  • The amount of work already completed

  • Any resources, planning, or production work already allocated

Please note the following refund conditions:

  • Upfront deposits are non-refundable once the project has been confirmed and work has started.

  • Completed work is non-refundable.

  • Services already delivered, partially completed, or in progress may not qualify for a refund.

  • Any approved refund will be calculated based on the remaining uncompleted work only.

  • Refunds, if approved, may take approximately 30 to 40 working days to process.

 

No Refund for Change of Mind

Patrick White Publishing does not offer refunds due to change of mind once a service has been confirmed, paid for, or started.

This includes situations where the client:

  • No longer wishes to continue

  • Changes their personal preference

  • Decides not to proceed with publishing

  • Changes direction after the project has started

  • No longer requires the service after work has been initiated

Once a project begins, time, planning, creative resources, staff allocation, administrative work, and production work are committed to the client’s project. For this reason, change of mind does not qualify as a valid reason for refund.

 

6. Client Responsibilities

The client is responsible for providing all required materials and information needed to complete the project, including but not limited to:

  • Accurate project details

  • Manuscript files

  • Images or references

  • Feedback and approvals

  • Required access or account details, where applicable

  • Any other content necessary for the agreed service

The client must ensure that all content provided is original, owned by them, or properly licensed for use.

Delays in providing materials, feedback, approvals, or payments may affect the project timeline.

 

7. Revisions and Approvals

Revision terms may vary depending on the service purchased. Included revisions, if applicable, will be confirmed in the project agreement, invoice, or written communication.

Revisions must remain within the original agreed project scope.

Requests that may be treated as additional work include:

  • A new concept or direction

  • Major restructuring

  • Additional pages

  • New illustrations

  • New design direction

  • Rewritten content

  • Work outside the approved brief

Such requests may incur additional charges.

Client approval may be required at key stages of the project. Once a stage, design, illustration, manuscript, layout, or final file is approved, further changes may be chargeable.

 

8. Intellectual Property Rights

The client retains ownership of their original ideas, manuscript, content, and materials provided to Patrick White Publishing.

Upon full payment, the client will own the rights to the completed final work created specifically for their project, including:

  • Written content

  • Illustrations

  • Cover design

  • Formatting

  • Other agreed deliverables

This applies unless otherwise stated in writing.

Patrick White Publishing may retain copies of work for internal records and may use completed projects for portfolio or promotional purposes unless otherwise agreed in writing.

Third-party materials, including stock images, fonts, templates, software, or licensed assets, may be subject to separate licensing terms.

 

9. Timelines and Delivery

Patrick White Publishing makes every reasonable effort to meet agreed project timelines. However, timelines may vary depending on:

  • Client response times

  • Revision requests

  • Project complexity

  • Workload

  • Approval delays

  • Payment delays

  • Circumstances beyond our control

Delays caused by late feedback, missing content, incomplete information, or changes to the project scope are the responsibility of the client and may extend the delivery timeline.

 

10. Publishing and Sales Disclaimer

Patrick White Publishing provides professional publishing support and related services. However, we do not guarantee specific:

  • Sales

  • Royalties

  • Rankings

  • Reviews

  • Audience response

  • Media attention

  • Commercial success

The success of a published book depends on many external factors, including market demand, pricing, author promotion, audience interest, competition, platform algorithms, and ongoing marketing efforts.

 

11. Limitation of Liability

To the maximum extent permitted by law, Patrick White Publishing is not liable for indirect, incidental, consequential, or financial losses, including:

  • Loss of sales

  • Loss of profits

  • Loss of opportunity

  • Platform-related issues

  • Delays caused by third-party platforms or services

Our total liability is limited to the amount paid by the client for the specific service in question.

Clients are responsible for keeping backup copies of their own files, manuscripts, images, and materials.

 

12. Termination of Services

A client may request to terminate services in writing.

If services are terminated after work has started:

  • The client may be charged for all work completed up to the date of termination.

  • Deposits are non-refundable.

  • Payments for work already started or completed are non-refundable.

Patrick White Publishing may terminate or pause services in cases of:

  • Non-payment

  • Abusive communication

  • Breach of terms

  • Illegal or unethical requests

  • Failure to provide required materials or feedback

 

13. Confidentiality

Patrick White Publishing respects client confidentiality and will take reasonable steps to protect:

  • Project information

  • Manuscripts

  • Personal details

  • Unpublished materials

  • Client-provided documents and references

Client information will only be used for the purpose of providing the agreed services, unless otherwise required by law or agreed by the client.

 

14. Governing Law

These Terms and Conditions are governed by the laws of Australia.

Any disputes will be handled in accordance with the applicable laws and jurisdiction stated in the relevant agreement or governing region.
